Please read the Terms & Conditions of engaging with Empower Occupational Therapy Limited. We know fine print can be tedious, but it is here to protect both you and us.
Service Agreement
  - Our services are available to individuals of all ages; however, clients under 18 must have consent from a parent, guardian, or designated caregiver.
- We require confirmation that you are medically fit to engage in occupational therapy services. If in doubt, please consult your GP. You must complete our consent form prior to commencing services. We will take all reasonable care, and you must also act sensibly and responsibly while engaging in our services.
- Your engagement with our services is subject to this agreement and our policies, which may be updated from time to time. We will notify you of any changes. These may include modifications to services, schedules, policies, or procedures. Some services (e.g., specialist assessments, travel fees, and extended therapy sessions) may incur additional costs beyond standard service fees.
- Your agreement with us applies to you personally. You may not transfer your engagement to another individual unless formally arranged in writing. We welcome referrals but require all new clients to undergo the appropriate intake process.
- You must inform us promptly of any changes to your personal details, including address, contact information, and relevant medical conditions.
- We reserve the right to review service applications and information to ensure suitability before proceeding with engagement.
- Fees for services must be paid in full and on time. You are responsible for ensuring payment, including any bank fees or charges. If a payment fails, we may attempt to recover the amount through subsequent invoices or direct debits. Administrative charges may apply for late payments.
- Should our fees change, we will provide reasonable notice in writing to your nominated email address, with at least one month’s notice. Changes to fees will take effect no sooner than one calendar month from the date of notification.
Cancellation, Suspension & Service Restrictions
  - You may cancel your services at any time by providing two weeks’ written notice. Certain contracts or funding arrangements may have specific terms regarding cancellations, which will be outlined separately.
- We reserve the right to suspend or restrict services if there are reasonable concerns regarding safety, non-compliance with our policies, or breaches of this agreement. This may also apply in cases where continuing services is deemed unsafe for the client or therapist.
Service Holds
  - If necessary, you may request to place your services on hold for up to two weeks per year without incurring additional charges. Requests for longer suspensions will be assessed on a case-by-case basis.
Liability & Responsibilities
  - If you cause damage to our premises, equipment, or property due to reckless, dangerous, or negligent behaviour, you will be liable for reasonable repair or replacement costs.
- We are not liable for any loss or damage arising from your use of our services, except where consumer rights apply under New Zealand law. Compensation for personal injury may be covered by the Accident Compensation Act 2001.
- By accessing or using our services, you acknowledge and accept these Terms & Conditions. You must inform us of any changes to your health that may affect your engagement in therapy. If in doubt, you should consult your medical practitioner.
- External professionals such as physiotherapists or personal trainers may operate in conjunction with our services but are not our employees. If you engage with an external professional, you must enter into an agreement with them separately and handle payments directly.
Disputes & Complaints
  - If you have a complaint or dispute, we encourage you to discuss it with us in the first instance. If we cannot resolve the matter informally, you may submit a written notice detailing your concerns and desired resolution. Both parties will endeavour to resolve disputes in good faith, including a meeting within 20 working days. Legal proceedings should not commence until this process has been followed.
General Terms
  - This agreement constitutes the entire agreement between you and Empower Occupational Therapy Limited and supersedes any previous negotiations or representations. Amendments to this agreement must be made in writing and signed by both parties. This agreement is governed by the laws of New Zealand.
- Definitions within this agreement:
  - “We”/“us”/“our” refers to Empower Occupational Therapy Limited.
- “You”/“your” refers to the client receiving services under this agreement.
- “Agreement” refers to these Terms & Conditions, including any additional terms agreed upon in writing.
- “Services” refers to the occupational therapy services provided by Empower Occupational Therapy Limited.
- “Fees” refers to all payments due under this agreement, including service charges and applicable administrative fees.
